Oregon State Measure 80 on Cannabis: A Libertarian Hobson’s Choice

Reading through the text of Oregon State Measure 80, the Measure that would de facto legalize cannabis in the State of Oregon, a Libertarian might be tempted to through up his arms in dismay, as he ploughs through the myriad conditions that will accrue if this bill is passed, from yet another State Commission, to a tax on medical cannabis sold through State-licensed pharmacies, to proceeds from the sale of this medicine ending up in state coffers. The complexity of the Measure will probably be a turn-off to anyone not having a personal stake in the issue, but the bill contains one revolutionary clause that is a Jeffersonian bomb thrown in the midst of a Fascist gathering: Section 474.065, Paragraph 3.

Section 474.065, Paragraph 3 may be the most Libertarian little phrase, at least in its effect, to quietly drop from the pen of a Hempster-Libertarian since Mayor Al Smith laid into the hated Prohibiton Laws when they were finally thrown in the gutter where they belonged. What this paragraph does is legalize the growing of cannabis for personal consumption without state interference from arrest or taxation. Those adults who want to use cannabis for any reason whatsoever, be it medicinal, philosophical or hedonistic, could now do so without the Fascist Miscreants of the State sticking their noses into the Individual’s private affairs. Those who need cannabis of a certain strength for serious medical conditions could buy it at state-licensed dispensaries, where they will pay through the nose but get what they need to alleviate their conditions. We don’t like the idea of the State being involved at all in a private citizen’s medical treatment, but if the State is going to certify the potency of various strains of medicinal cannabis, then it is appropriate that the state taxpayers be compensated for the associated costs. We think prices of $10/gram and up are outrageous for a plant that can be grown as prolificly as wheat or corn, but then the patient is still permitted, under Section 474.065 Paragraph 3, to grow his own without cost to himself, so there is an alternative.

One outrageous provision of the Measure, Section 474.155, would outlaw the consumption of cannabis in public, punishable by a $250 fine, with a few exceptions, like prominent signs permitting cannabis use in that area. We find this provision ludicrous in a society that is so permissive that it permits tobacco addicts to smoke in public streets, thereby assaulting the bodies (and the property rights vested in their bodies) of all passers-by, even children. And what of the medical cannabis user who must suddenly take a dose to alleviate spasms or pain while in a public place? Should they be made criminals and forced to pay such an outlandishly unfair fine?

And what of the homeless? Under this provision they will never be able to use cannabis if they wanted, since they are on public property virtually 100% of their time. They should not be denied the Right to use cannabis merely because they do not have the price of a domicile.

No, the correct course is to legalize usage in public as long as the smoke from the cannabis does not reach any unwilling citizen and assault their property right to not have their bodies invaded by anything, harmful or beneficial. It should be illegal to smoke cannabis within 100-200 yards of another person without their consent, just as it should be with tobacco, although the penalty for tobacco should also include jail time.

On the positive side, the Measure seems to tackle the question of what impairment, if any, cannabis causes, and its effect on drivers. It seeks to set standards through medical research, although, as an Anti-vivisectionist, Silverwolf hopes these studies will be carried out solely on human beings. It also sets a standard of presumed negligence in any accident that might occur involving impaired motorists prior to getting the results of the impairment research. And it also prohibits the trafficking of cannabis to minors, although we think the phrase should have read “delivery to minors”.

The Measure also rips apart the puerile restrictions on hemp farming which would quickly balloon into a huge industry if it were legalized. The American Communists of the Democratic and Republican Parties have certainly shot American Capitalism in the foot on this one. Only the Libertarians and Ron Paul Republicans have had the moxie to call for the legalization of hemp farming for the last few decades. The Commies have been winning so far.

Finally and remarkably, the Measure mentions the violations of Religious Liberty the Bipartisan Prohibitionists have inflicted on anyone who adheres to the values of the Old Testament, for in Genesis 1:29 it gives to all men the use of all herb-bearing seeds. This assault on Religous Liberty by the Communists will also be swept away if the Measure passes.

So, despite its flaws and its many bad points, Measure 80’s Libertarian Section 474.065 Paragraph 3, and its concern with establishing an impairment level, if any, justify a “Yes” vote. And that’s just how Silverwolf voted.

Silverwolf’s Jeffersonian Epistle to the Fascist, President Obama

In light of the Hitlerian NDAA Bill, signed by the President on December 31, 2011, a day that will live in Infamy, which allows the US Military to arrest and secretly detain in military prisons for an indefinite period any US Citizen without benefit of a lawyer, and in light of the President’s claimed authority to assassinate American Citizens at will on a White House “Kill List”, and in the light of the President’s Murder of another 18 women and children in a NATO air strike in Pakistan, and in light of all the other Human Beings he has Murdered and permanently maimed in his immoral drone strikes in Afghanistan, Pakistan, and Yemen, and in light of the President’s denying to the terminally ill in those States which have legalized medical cannabis the use of that medication, which in itself is another form of premeditated Murder, Silverwolf addresses the following Jeffersonian epistle to the President:

Sire,

No longer persevere in sacrificing the Rights of One Individual to the inordinate desires of the Executive Branch, but deal out to all equal and impartial Right.

Let no act be passed by Executive Order that may infringe on the Rights and Liberties of the Individual, but deal out to all equal and impartial Right.

These are our grievences, which we have thus laid before Your Majesty with that freedom of language and sentiment which becomes a free people, claiming their Rights derived from the Laws of Nature, and not as the gift of their chief executive.

Let those flatter who fear. It is not an American art.

Presidents are the servants, not the proprietors of the People. Open your breast, Sire, to Libertarian and expanded thought. Let not the name of Barack Obama be a blot on the page of History. It behooves you  to think and act for yourself and your People. The whole Art of Government consists in the art of being Honest.

We are willing, on our part, to sacrifice everything which Reason can ask to restore tranquillity. On your part, be willing to restore the Bill of Rights on a generous plan.

The G-d who gave us Life, gave us Liberty. The hand of Force may destroy, but cannot disjoin them.

Obama’s First Hundred Days: The Audacity of Hypocrisy

Barack Obama doesn’t disappoint. At least, he didn’t disappoint Silverwolf’s expectations for another Presidency filled with hypocrisy and phony and immoral policies, just like the previous Clinton administration, as we view his first hundred days in power. All Silverwolf can say is, after the first hundred days, thank goodness there are only 1341 days to go.

First off, let’s look at the President’s lying policy on medical cannabis. During the campaign, Herr Obama pledged to not prosecute any medical cannabis suppliers if they were in compliance with State laws. In other words, if the States legalized medical cannabis, the Federal government wouldn’t intervene. But now, in blatant contradiction of his “solemn” campaign pledge, Obama’s hand-picked DA, Eric Holder, says the Federal government will prosecute a grower in California, Charles Lynch, who was growing in accordance with California state law, and will seek the maximum five-year penalty. We can see that, when it comes to cannabis, Obama is as big a Fascist as Clinton, the Government of Singapore, or Comrade Castro.

And of course, he is drumming up the “war on drugs” again, the same tired rhetoric we’ve heard from every Democrat and Republican since Lying Bain-of-the-world Johnson. An instant worldwide end to prohibition would end the drug war once and for all, by taking the profits out of it. But such a simple solution is too logical for the simple mind of our new simpleton President.

Then, of course, there is Obama’s continual escalation of his war in Afghanistan, a hopeless cause as the British, Russians, and anyone else has found out who has tried to control that mountainous region. Obama is already sending more troops than he originally said he would be sending, and let’s remember that he has asked for a 9% increase in the Military-Industrial giveaway of the wealth of American Capitalism to the military suppliers. Some military is of course necessary, but we’d guess we could defend our own borders for one-fifth of what we spend maintaining 700 military bases around the world.

Obama has also committed his first war crimes in Afghanistan, killing women and children, it was reported, during the drone attacks on Islamic militants. Perhaps the women were named Michelle and had two daughters? Perhaps their income was $2.7million? Perhaps the President would not have authorized this attack if the price were his wife and children? But, as Madelaine Alldull once said, that’s collateral damage for ya.

Now let’s move on to the President’s disgraceful behavior in virtually nodding to the Queen of England, a Democracy and once a hot-bed of civil rights, while bowing low before the King of Saudi Arabia,  a Kingdom that chops off hands and heads, forbids women to drive, and forbids Christians to bring in their Bible. Should an American President bow low before such a tyrant and civil rights violator, while merely nodding to someone who oversaw the largely peaceful liberation of dozens of former colonies in her Empire back into the hands of their native owners? Has the Queen of England denied Muslims and Jews the right to worship in her overwhelmingly Christian country? The answer is no, and for that alone the Queen of England, if anyone, deserved the deeper bow, not the nominal head of a civil rights cesspool. De rigeur, the White House tried to wriggle out of this one, by claiming that Obama bowed so low before the Saudi King, because the King is so short. However,  they failed to mention that the Queen of England is, in point of fact, even shorter, something that was never mentioned by the White House staff. .

 But of course, what can we expect when Obama appoints Hillary Clinton as Secretary of State, a woman whose husband has received millions upon millions of dollars for his official library from the Saudis?  No conflict of interest there, is there Mr. President? And this woman is supposed to be an objective force in the midst of Middle East negotiations. But Ms. Rod-’em has already been turning up the pressure on the Israelis, in accordance with the wishes of her masters in Riyadh, by threatening Israel that if it didn’t start talking to the Palestinians, even while they continue to rain down missiles on Israeli civilians, already killing and maiming many, that Israel will lose its “support amongst the Arabs” in its opposition to Iran’s nuclear threat. “Support amongst the Arabs”? Is the woman insane, or merely relaying the message from Riyadh, which is now the message from Obama’s Washington? This is all exactly as Silverwolf expected.

The President’s wrecking of the US dollar, as he adds two Trillion dollars to the national debt in one year, and passes out hundreds of billions of dollars to the donors of the Democratic machine, has already been commented on extensively in Silverwolf’s many blogs on the subject, so he won’t go over old ground again. Suffice it to say that Austrian-oriented economists and investors know exactly what a virtual crime, a legalized theft of the wealth of the American people, under color of Law, is now taking place. Unfortunately, it will take a collapse of the dollar to bring most Democrats around to a sense of reality. But they voted in their own collapse, and as we are all responsible for our own actions, you can’t get too worked up when someone slits their own throat. We warned ’em.

However, perhaps the most egregious hypocrisy of the new Administration is the fact that they have not removed all the myriad overthrows of our civil rights laws — the unpatriotic and Bill-of-Rights busting Patriot Act,  and the Military Commissions act, which overthrows the ancient Principle of Habeas Corpus. The fact that the Democrats have not said a peep about these civil rights usurpations in the first hundred days is very telling. They realized they have pacified the womanized American public. A nation of sheep on estrogens.

And finally, as a cherry on this audacious cake of hypocrisy,  we come to the President’s disgusting warm-handshake and big smile when encountering the Collectivist of Caracas, the obese Hugo Chavez, dictator of a thin people. While diplomatic decorum would require that a head of state not blatantly insult a nominal head of a dictatorship, Silverwolf believes that the head of any country that not only violates human rights, as Venezuela does, but also engages in whipping up hatred against religious minorities, as Chavez did when he called Jews the killers of Christ in a speech not long before a synagogue in Caracas was invaded and trashed, and its occupants beaten— such a head of state should be treated with the utmost frigidity by any American President.  Such blatantly racist inciting to riot should have required no handshake at all, merely a sombre nod of the head. But what would one expect from someone who regarded Rev. Wright as his spiritual mentor, and who hung out for twenty years with folks who would give Louis Farrakhan their Man of the Year award. Being a racist bigot and a Fascist doesn’t seem to deter the President from flashing his biggest smile, and extending the hand of “friendship”. But Silverwolf, and America, can dispense with such “friends”.

No, President Obama has not disappointed Silverwolf’s expectations in the least. But actually, since this blog has taken a day to write, Silverwolf has good news for the American people. Now there are only 1340 days to go.
